Terms of Service

These Terms of Service govern your access to and use of the Vitomedia website and service ("Vitomedia", "we", "us"). By purchasing a pack or using the service, you agree to these Terms.

1. The service. Vitomedia transcribes the speech from a video you provide, times each line to the moment it is said, optionally translates that text into another language, and renders the result onto the video. Packs provide captioning minutes for your account.

2. Eligibility and accounts. You must be at least 13 years old, or the age of digital consent in your country, to use the service. Your pack is linked to the email address of your Vitomedia account. You are responsible for the accuracy of that email and for the security of your account.

3. Packs and purchases. Packs are one time purchases. They are not subscriptions and do not renew automatically. Minutes are deducted by the length of the section you send for processing. Minutes do not expire.

4. Prepaid use, not stored value. Minutes are a prepaid quantity of use of the Vitomedia software. They are not currency, credit, or stored value of any kind. Minutes have no cash value, cannot be redeemed for cash, and cannot be transferred, gifted, or resold to another person. They can only be used for captioning inside Vitomedia, on the account they were bought for. Minutes do not expire, but they remain tied to that account.

5. Delivery. Packs are digital and are delivered automatically. Your minutes are added to the account linked to the email you provide at checkout, normally within a few minutes of a successful payment.

6. Pricing and taxes. Prices are shown in US dollars. The price shown is the total you pay, with no additional taxes added at checkout. Prices may change for future purchases, but a change does not affect a purchase already completed.

7. Seller. We are the seller and merchant of record for your purchase. Payments are securely processed by our payment provider. Your purchase remains subject to these Terms.

8. Your content and acceptable use. You are responsible for the videos you send for processing, and you confirm that you hold the rights needed to do so. You must use the service in line with our Acceptable Use Policy. We may refuse processing, remove content, or suspend accounts that violate that policy or applicable law.

9. Accuracy. Transcription and translation are produced automatically and are not guaranteed to be accurate or complete. The transcript editor exists so you can correct any line before exporting. You are responsible for reviewing the result before you publish it. If a translation cannot be completed for a technical reason, the transcript is delivered in its original language and the minutes are still deducted, because the transcription itself was done.

10. Refunds. Refunds are handled as described in our Refund Policy.

11. Intellectual property. The Vitomedia name, website, and software are owned by us. Your videos and the transcripts produced from them remain yours. We claim no ownership of the content you provide.

12. Service availability. We work to keep the service available, but we do not guarantee uninterrupted or error free operation. Processing requires an internet connection. We may update, suspend, or discontinue features.

13. Disclaimers. The service is provided on an "as is" and "as available" basis, without warranties of any kind to the extent permitted by law. You are responsible for keeping your own copies of any video you consider important.

14. Limitation of liability. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss of data, arising from your use of the service.

15. Changes. We may update these Terms. Material changes will be posted on this page with a new "Last updated" date.
